Public Offer Agreement

Effective date: September 21, 2026
Last updated: September 21, 2026

1. Merchant and nature of this offer

This Public Offer Agreement (“Offer”) is made by Individual Entrepreneur Baranov Viacheslav Petrovych (ФОП Баранов Вячеслав Петрович), Tax ID 3110407633, legal and business address: Ukraine, 65043, Odesa Region, Odesa, 40 Zabolotnoho Street, Apt. 156 (“Merchant” or “FitOnBoard”). It states the terms on which an individual customer may purchase FitOnBoard digital access.

Where legally applicable, selecting the paid offer, confirming agreement at checkout, and successfully paying constitutes acceptance and forms an electronic agreement between the customer and the Merchant. Browsing the site or using FREE features does not authorize a charge.

2. Subject and service

The Merchant provides time-limited access to FitOnBoard — Fitness for Sailors, a digital fitness service at maritime.fitness. It may include the workout generator, exercise/workout library, training guides, workout player, history, progress, XP, SeaCoin/rewards, and account features. The precise features available are those described on the site for the customer’s access level.

3. Electronic delivery

No physical goods are shipped. No delivery service is used. Free and purchased access are supplied electronically through the customer’s FitOnBoard account/site access as implemented. Paid access starts after successful payment and confirmation, ordinarily promptly, although verification or technical processing may cause a reasonable delay.

4. Free access

FREE access is permanent, requires no payment card, and causes no automatic charge. PRO content requires active personal or company access.

5. Subscription and price

The current intended individual price is USD 14.99 per month. The final price displayed before payment applies. The first paid period begins only after the customer actively chooses to subscribe and payment is successful.

6. Payment procedure

When payment integration is active, online card payment is or will be processed securely through WayForPay. Only the methods actually displayed at checkout are offered. The customer must provide accurate payment and account information and have authority to use the selected method. FitOnBoard may receive a transaction reference, amount, and status, but does not claim to store complete bank-card details.

If recurring monthly billing is enabled, it will be clearly disclosed before confirmation. The subscription will then renew monthly until cancelled. Cancellation prevents future renewals and charges and normally preserves access through the already-paid period. Recurring billing must not be inferred when checkout does not offer and disclose it.

7. Cancellation and refunds

The customer may cancel future renewal at any time through an available account method or by contacting FitOnBoard. A refund request may be submitted within 14 calendar days after the relevant payment and will be reviewed individually under the Refund Policy. Approval may apply to substantiated service problems, duplicate or incorrect charges, inability to access caused by FitOnBoard, or where law requires it. No provision limits mandatory rights.

8. Merchant rights and obligations

The Merchant will provide purchased electronic access, take reasonable steps to operate and secure the Service, provide support, and respect applicable consumer and data-protection duties. The Merchant may maintain, update, suspend, or modify the Service; prevent misuse; and suspend or terminate access for a material breach, subject to mandatory law and appropriate notice where practicable.

9. Customer rights and obligations

The customer may receive the purchased access, seek support, cancel future renewal, submit a refund request, and exercise mandatory legal rights. The customer must provide accurate information, protect credentials, use the Service lawfully, follow health and vessel-safety precautions, and not copy, redistribute, resell, attack, reverse engineer, or bypass the Service or access controls.

10. Intellectual property

All rights in FitOnBoard and its content remain with the Merchant or relevant licensors. Purchase grants only a limited, non-exclusive, non-transferable right to use the Service for the applicable access period. Content may not be reproduced or commercially exploited without written permission.

11. Availability and liability

FitOnBoard will use reasonable care but does not promise uninterrupted availability. Maintenance, internet connectivity, vessel conditions, and third-party infrastructure may affect access. Fitness content is general information and not medical advice. To the extent permitted by law, the Merchant is not liable for indirect or consequential loss or loss caused by misuse or events outside reasonable control. Liability and consumer remedies that cannot legally be limited remain unaffected.

12. Force majeure

Neither party is responsible for delay or failure caused by circumstances beyond reasonable control, including natural events, war, civil disturbance, government action, widespread network or utility failure, cyberattack despite reasonable safeguards, or disruption of critical providers. Obligations resume when reasonably possible; payment obligations already due are not excused unless law requires otherwise.

13. Privacy and personal data

Personal data is processed to create and administer accounts, provide access, process payment status, secure and improve the Service, support customers, and meet legal duties, as described in the Privacy Policy. Payment data may be processed directly by WayForPay when available.

14. Corporate customers

Shipping companies obtain corporate access under a separate direct agreement and pay by bank transfer under that agreement. FitOnBoard supplies a unique corporate access/invite link for eligible seafarers. A separate written corporate agreement, rather than the standard consumer checkout and this Offer, governs those services where it applies.

15. Term and termination

The agreement starts upon valid acceptance and successful payment and continues for the purchased period and any disclosed renewals. It ends when access expires following cancellation, or may be terminated for material breach. Provisions intended to survive, including intellectual-property, payment, liability, and dispute terms, continue as applicable.

16. Governing law

This Offer and resulting agreement are governed by the laws of Ukraine, without removing mandatory consumer protections applicable in the customer’s country of residence. Disputes are determined by competent courts or authorities under applicable law after the parties first attempt an amicable resolution.
