1. Introduction
These Terms & Conditions (“Terms”) govern access to and use of FitOnBoard — Fitness for Sailors at maritime.fitness (the “Service”). By creating an account, using the Service, or purchasing access, you agree to these Terms. If you do not agree, do not use the Service.
2. Service provider and merchant
The Service is provided by Individual Entrepreneur Baranov Viacheslav Petrovych (ФОП Баранов Вячеслав Петрович), Tax ID 3110407633, Ukraine, 65043, Odesa Region, Odesa, 40 Zabolotnoho Street, Apt. 156 (“FitOnBoard”, “we”, “us”). The business address is the same as the legal address.
3. The FitOnBoard Service
FitOnBoard provides digital fitness content and tools designed primarily for seafarers, including a workout generator, exercise and workout library, training guides, workout player, workout history, fitness progress, XP, SeaCoin/reward functionality, and account features. Features may be added, changed, or withdrawn as the Service develops.
4. Eligibility and accounts
You must be legally capable of agreeing to these Terms and meet any minimum age required by applicable law. You must provide accurate account information, keep login credentials confidential, and promptly notify us of suspected unauthorized use. You are responsible for activity through your account except where applicable law provides otherwise.
5. Digital service and electronic access
FitOnBoard supplies digital services only. No physical goods are shipped and no physical delivery service is used. Free and paid access are provided electronically through your FitOnBoard account at maritime.fitness. Internet access and a compatible device are your responsibility.
6. Free access
FitOnBoard offers permanent FREE access without a payment card or account. PRO content requires active personal or company access. Free use never authorizes a charge.
7. Individual subscription, price, and payment
The current intended individual subscription price is USD 14.99 per month. The price and applicable currency shown at checkout before purchase control if they differ due to an announced change. A paid subscription begins only after you actively choose to subscribe and payment succeeds.
When the payment integration is active, online card payments are or will be processed securely through WayForPay. Available payment methods are those displayed by the active checkout; we do not promise any particular card brand or wallet. WayForPay processes payment data under its own terms and privacy practices. FitOnBoard may receive the transaction reference and payment status needed to provide access and keep records.
8. Renewal and cancellation
Recurring billing is not represented as active unless the checkout clearly says it is. If recurring monthly payments are enabled, the checkout will disclose them before purchase and the subscription renews monthly until cancelled. You may cancel future renewal at any time using an available account method or by contacting us. Cancellation prevents future charges but normally leaves access available through the already-paid billing period, unless applicable law requires otherwise.
9. Corporate access
Corporate access is not purchased through the consumer checkout. A shipping company enters a separate direct agreement with FitOnBoard and pays by bank transfer under that agreement. FitOnBoard then supplies a unique corporate access or invite link for eligible seafarers. Where a separate written corporate agreement applies, it governs the corporate service and takes precedence over these consumer subscription provisions.
10. User responsibilities and prohibited use
Use the Service lawfully and only for personal or expressly authorized corporate use. Do not share access improperly; copy, sell, scrape, reverse engineer, or redistribute content; bypass access controls; interfere with security or operation; upload malicious code; impersonate another person; exploit SeaCoin, XP, or completion systems; or use the Service to violate another person’s rights.
11. Fitness and health disclaimer
FitOnBoard provides general fitness information, not medical advice, diagnosis, treatment, or an individualized medical program. Exercise involves risk. Consider consulting a qualified healthcare professional before starting, especially if you have an injury, medical condition, are pregnant, or have concerns. Choose exercises appropriate for your ability, inspect equipment and surroundings, stop if you feel pain, dizziness, or unusual symptoms, and seek medical assistance when appropriate. Never exercise where doing so conflicts with vessel safety rules or duties.
12. Intellectual property
The Service, branding, software, layouts, text, graphics, exercise presentation, and other content are owned by or licensed to FitOnBoard and protected by applicable intellectual-property law. We grant you a limited, personal, non-exclusive, non-transferable, revocable right to use the Service during authorized access. No ownership rights are transferred.
13. Availability and changes
We aim to keep the Service available but do not guarantee uninterrupted or error-free operation. Maintenance, connectivity, security, vessel internet conditions, and events outside our control may affect availability. We may reasonably update features, content, technical requirements, and pricing. Material subscription changes will be communicated as required by law and will not retroactively alter an already-paid period.
14. Liability
To the fullest extent permitted by applicable law, FitOnBoard is not liable for indirect, incidental, special, or consequential loss, loss caused by misuse, or circumstances outside our reasonable control. Nothing in these Terms excludes or limits liability, remedies, or consumer rights that cannot lawfully be excluded or limited.
15. Refunds
Cancellation and refund requests are handled under our Refund Policy. A refund may be requested within 14 calendar days after the relevant payment and is reviewed individually; this is not an unconditional refund promise except where applicable law requires one.
16. Privacy
Our Privacy Policy explains how personal data is processed, including account, workout, access, and transaction-status information.
17. Governing law and disputes
These Terms are governed by the laws of Ukraine, without depriving a consumer of mandatory protections applicable in the consumer’s country of residence. Please contact us first so we can attempt to resolve a concern. Disputes are handled by competent courts or authorities under applicable procedural and consumer law.
18. Changes to these Terms
We may update these Terms to reflect legal, operational, or Service changes. The updated version and date will be posted here. Where required, material changes will be notified separately. Continued use after an effective update constitutes acceptance only to the extent permitted by law.
